The SWIFT North American Operations Data Center holds the organization's operational files mirrored from those in the Belgium home operations. In defense of SWIFT allowing the US Treasury to access its files, SWIFT claims that by being located in the US the files were subject subpoenas issued by the US government in search for financial transactions possibly related to terrorism.

The European Commission issued an opinion on November 22, 2006, declaring that this access violated European data privacy law and directed that the practice cease.
